These Terms of Service ("Terms") govern your use of SmartStack IQ's services. By using our services, you agree to these Terms. Please read them carefully.

1. Services

SmartStack IQ provides AI-powered automation services for home service businesses, including but not limited to: automated missed call response via SMS, AI-driven lead qualification, appointment scheduling assistance, and related communication tools.

2. Eligibility

Our services are available to businesses operating lawfully in the United States. By using our services, you represent that you have the authority to enter into these Terms on behalf of your business.

3. Messaging Services & Compliance

By using our SMS services, you agree to:

• Use messaging only for legitimate business communication with individuals who have initiated contact with your business
• Comply with all applicable laws including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines
• Honor all opt-out requests (STOP replies) immediately
• Not use our platform to send spam, unsolicited commercial messages, or any illegal content
• Provide accurate business information for A2P 10DLC registration

Message and data rates may apply to end users. Message frequency varies based on customer interactions.

4. Opt-Out Instructions

End users may opt out of receiving messages at any time by replying STOP to any message. To receive help, end users may reply HELP. SmartStack IQ will honor all opt-out requests within one business day.

5. Payment & Billing

Services are billed on a monthly subscription basis. Fees are charged in advance at the beginning of each billing period. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days written notice.

6. Acceptable Use

You may not use SmartStack IQ to:

• Send messages that are deceptive, fraudulent, or misleading
• Harass, threaten, or harm individuals
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Transmit malware or harmful code

7. AI-Generated Content

Our platform uses artificial intelligence to generate SMS responses on behalf of your business. You are responsible for reviewing AI-generated content and ensuring it accurately represents your business. SmartStack IQ is not liable for any misrepresentations made by AI-generated messages.

8. Limitation of Liability

SmartStack IQ's liability to you for any claims arising from these Terms or our services shall not exceed the fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Termination

Either party may terminate these Terms with 30 days written notice. We reserve the right to immediately suspend or terminate services for violations of these Terms or applicable law.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of our services constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
